The periods to which the Consultant commits his/herself only concern the provision of his/her own services, notwithstanding elements that do not depend upon his/her own Scope of Services.
The Work Stages and their corresponding timescales, to which the parties commit themselves, are defined below:
Work Stage A.1 “Preliminary Research“. This Work Stage shall be carried out within […] weeks as from the signature of this Agreement.
Work Stage A.2 “Preliminary Design for Building Authorisations“.
This Work Stage shall be carried out within […] weeks as from the approval of the previous Work Stage and payment of the corresponding fees.
Work Stage A.3 “Final Design for Construction“. This Work Stage shall be carried out within […] weeks as from the approval of the previous Work Stage and payment of the corresponding fees.
Work Stage A.4 “Construction Monitoring“. The Contractor projects that this phase shall be carried out within […] months as from the approval of the previous Work Stage and payment of the corresponding fees.
Work Stage B.1 “Preliminary Research“. This Work Stage shall be carried out within […] weeks as from the approval of the previous Work Stage and payment of the corresponding fees.
Work Stage B.2 “Project“. This Work Stage shall be carried out within [...] weeks as from the approval of the previous Work Stage and payment of the corresponding fees.
The approval periods, the implication of instructions or additional decisions by the Client and his/her technical assistants, other intervening parties or authorities extend the timetable.
The provision of services in the month of [.], or during the holidays of [...] increase by […] days the period of the Work Stages. (e.g. August in Southern Europe, Ramadan or the Chinese New Year).
After the submittal of documents for a Work Stage, the Client shall make his/her comments known, in a coherent manner, together with those of other interested parties (Project Manager, Technical Controller,....) to the Consultant within a period of […] days following the Work Stage submittal.
Beyond this period, the Work Stage is considered to be approved. The Client comments and those of his/her Technical Advisors are integrated into the following Work Stage which starts as soon as the comments have been received. To pass from one Work Stage to another implies approval by the Client of the provisions of the previous Work Stage after submittal of the documents for a Work Stage.
Should the Client not provide comments and beyond the above-mentioned period for approval, the Work Stage is considered as being approved and the Consultant may proceed with the following Work Stage.
Should the Client refuse to approve Consultant services, he/she must notify the latter and confirm in writing with any supporting evidence.
The construction period is estimated to be […] months or years. The fees under this Agreement are determined accordingly.
The Consultant proceeds with a Work Stage after the express or tacit approval of the Client and payment of the fees that correspond to the previous Work Stage.
Any change to the time periods for approvals on behalf of the Client shall be recorded as an amendment to the Agreement.
